1.Withdrawal from the Contract
1.1. The Seller is entitled to withdraw from the Purchase Agreement due to stock exhaustion, unavailability of goods, or if the manufacturer, importer, or supplier of the goods specified in the Purchase Agreement has interrupted production or made such significant changes that it became impossible for the Seller to fulfill its obligations. Furthermore, the Seller may withdraw for reasons of force majeure or if, despite exercising all reasonable efforts, they are unable to deliver the goods to the customer within the period specified in these Terms and Conditions.
1.2. The Buyer (Consumer) has the right to withdraw from the contract under the conditions regulated by Act No. 102/2014 Coll. on Consumer Protection in the Sale of Goods or Provision of Services under a Remote Contract or a Contract Concluded Outside the Seller's Premises, within 14 days from the date of receipt of the goods, even without providing a reason.
1.3. Goods are considered received by the Buyer at the moment when the Buyer or a third party designated by them (excluding the carrier) takes possession of all parts of the ordered goods, or:
If goods ordered in a single order are delivered separately: at the moment the last item is received.
If the goods consist of several parts or pieces: at the moment of receipt of the last part or piece.
If the goods are delivered repeatedly over a defined period: at the moment of receipt of the first delivered goods.
1.4. The Buyer may withdraw from the contract even before the withdrawal period begins. To exercise the right of withdrawal, any clearly formulated statement expressing the Consumer's decision to withdraw (e.g., via email) is sufficient. Send the statement to: info@curliculum.com
1.5. Withdrawal Form: Please send the Withdrawal Form to the email address: info@curliculum.com.
1.6. The Seller is obliged to refund the payment for the returned goods to the Consumer without undue delay, no later than 14 days from the date of delivery of the notice of withdrawal.
1.7. Upon withdrawal, the Seller is not obliged to return the payment before the goods are returned or until the Consumer proves that the goods have been sent back, unless the Seller offers to collect the goods personally.
1.8. If the Buyer withdraws from a distanceremote contract, the Buyer bears the costs of returning the goods to the Seller.
1.9. The Seller must return the payment using the same method used by the Buyer for the original transaction, unless agreed otherwise.
Shipping is FREE for purchases over €100. If, after returning part of the goods, the total value of the order falls below €100 (or if the entire order is returned), the refunded amount will be reduced by shipping costs: €5 (plus €1 seasonal surcharge from Nov 1 to Dec 31) for courier delivery, or €3 (plus €1 seasonal surcharge from Nov 1 to Dec 31) for Packeta pick-up points. A COD fee of €1.80 (or €1 for personal pickup at Eko sklad & Fulfillment) will also be deducted from the refunded amount.
1.10. The Buyer must send the goods back no later than 14 days from the date of withdrawal.
1.11. Goods must be returned undamaged and in their original condition. If the returned goods are damaged or incomplete, the Seller is entitled to compensation for the value of repairing the goods and restoring them to their original condition.
1.12. Cases in which the Buyer cannot withdraw: The Buyer cannot withdraw from a contract involving:
Products made according to the Buyer’s specific requirements or customized products.
Perishable products or products with a short shelf life.
Products in protective packaging that are not suitable for return for health protection or hygiene reasons and whose protective packaging was broken after delivery.
Products that, due to their nature, may be inseparably mixed with other goods after delivery.
1.13. Legal matters not covered by these Terms regarding withdrawal are governed by Sections 7 to 10 of Act No. 102/2014 Coll.
1.14. You can return goods via Packeta. When dropping off the parcel at any Packeta branch, provide the return code: xxxxx. Packeta will accept the parcel for free of charge and ship it back to us.
2. Liability for Defects and Warranty
2.1. Liability for defects, warranty, and claims (complaints) are governed by Act No. 40/1964 Coll. (Civil Code) and Act No. 250/2007 Coll. on Consumer Protection.
2.2. The Seller is responsible for defects that the product has upon receipt by the Buyer. For products sold at a lower price, the Seller is not liable for the defect for which the lower price was agreed. For used products, the Seller is not liable for defects caused by use or wear. The Seller is also not liable for defects caused by the Buyer (e.g., incorrect storage, maintenance, or misuse).
2.3. The standard warranty period is 24 months (12 months for used products), starting on the date of receipt.
2.4. For perishable products or products with a special nature, the warranty lasts until the expiration date indicated on the packaging or instructions.
2.5. Repairable defects: The Buyer has the right to free, timely, and proper repair. The Seller may always replace a defective product with a flawless one instead of repairing it, provided that it does not cause the Buyer significant inconvenience..
2.6. Irreparable defects: If the defect cannot be removed and prevents proper use, the Buyer has the right to replace the product or withdraw from the contract. The same applies to recurring defects after repair. For other irreparable defects, the Buyer is entitled to a reasonable discount or withdrawal.
3. Complaint Procedure
3.1. If the Buyer wishes to file a complaint, we recommend informing us in advance via email at info@curliculum.com within the warranty period. The Buyer must deliver the claimed products to the Seller together with the complaint form.
3.2. The Seller will assess the claim and handle it immediately, no later than 30 days from the date the complaint was filed. Handling the claim includes returning the repaired product, replacing it, refunding the purchase price, or providing a reasonable discount.
3.3. Complaint Submission Procedure:
