Contractual relations (including any other legal relations that may arise from them) with Buyers who are not consumers, i.e. legal entities and natural persons – entrepreneurs acting within their business activity, are governed by the relevant provisions of the Civil Code. The provisions of these T&C intended to protect consumers (in particular Article 8 on withdrawal from the contract without giving a reason and Article 10 on out-of-court resolution of consumer disputes) do not apply to such Buyers. The exercise of rights arising from defective performance (claims) is governed by Article 9 of these T&C.

2. Ordering a Product – Conclusion of the Purchase Contract

2.1. The Buyer’s proposal to conclude a purchase contract is an order of products placed through the electronic order form on the Seller’s website or by other means of distance communication, in particular by e-mail or telephone. Before submitting an order, the Buyer has the opportunity to check and correct the data entered in the order.

Where the products are paid for before they are delivered to the Buyer, the purchase price is deemed paid on the day the funds are credited to the Seller’s account.

2.2. The Seller accepts the order, and the purchase contract is thereby concluded, by sending the Buyer an electronic confirmation of receipt of the order.

2.3. The purchase contract (Section 2079 et seq. of the Civil Code) is concluded for a fixed term and expires when the obligations of the Seller and the Buyer have been performed.

2.4. The purchase contract may also terminate by the consumer’s withdrawal from the contract under Article 8 of these T&C.

2.5. The purchase contract may be concluded in the Czech language.

2.6. The concluded purchase contract, including these T&C, is archived by the Seller in electronic form and is made available to the Buyer upon request.

2.7. Costs incurred by the Buyer when using means of distance communication in connection with the conclusion of the purchase contract (e.g. internet connection or telephone call costs) are borne by the Buyer; these costs do not differ from the basic rate.

3. Purchase Price and Payment Terms

3.1. The price of goods and services ordered through the online store (hereinafter the “purchase price”) is stated separately for each product and is valid at the time the Buyer places the order.

3.2. The base currency is the Czech koruna (CZK).

3.3. The purchase price of goods and services includes VAT and is clearly stated in the Seller’s online store. By submitting the order, the Buyer accepts the stated purchase prices. The purchase price of products does not include transport costs or other costs related to the delivery of the products. Delivery methods and delivery charges are set out in Article 7, point 7.2 of these T&C. Payment methods and the fees for them are set out in Article 4, point 4.1 of these T&C. The Buyer undertakes to pay, together with the purchase price of the goods, the fees for the chosen delivery method and payment method.

4. Payment Methods

5. Delivery of Products

5.1. The Seller is obliged to fulfil the order and deliver the goods or services to the Buyer without undue delay, at the latest within 30 days of the conclusion of the purchase contract under Article 2, point 2.2 of these T&C, unless agreed otherwise with the Buyer. The usual delivery time for goods or services is 5 working days from the conclusion of the purchase contract under Article 2, point 2.2 of these T&C.

5.1.1. The Seller is obliged to deliver the products to the Buyer in the ordered quantity and quality, together with the tax documents relating to the order and other documents, if they exist and are typical for the given products or services.

5.2. The place of delivery of the ordered product is the address stated by the Buyer in the order.

5.3. The Seller delivers the product by its own means into the hands of the Buyer (or a person authorised in writing by the Buyer to receive the product) or through third parties (transport and courier companies).

5.4. Delivery of the product is completed by its acceptance by the Buyer (or a person authorised in writing by the Buyer to receive the product).

5.5. The Seller may send the Buyer goods that are immediately available and deliver the rest of the order later within the statutory period, provided that no additional costs are charged to the Buyer and only if the Buyer agrees.

6. Acceptance of the Product

6.1. The risk of damage to the product passes to the Buyer upon its acceptance, regardless of whether the Buyer takes over the product personally or through an authorised third party.

6.2. Title to the goods passes from the Seller to the Buyer upon payment of the purchase price and acceptance of the goods. Until then, the Seller retains title to the goods.

6.2.1. The Buyer has, among other things, the right not to accept the delivered product from the carrier, in particular in the following cases:

a) delivery of an item that is in breach of the concluded purchase contract (different or damaged item),

b) delivery of an item in damaged packaging, or

c) delivery of an item without the relevant documents.

6.2.2. If an item under point 6.2.1 of this Article, or an otherwise defective item, is delivered to the Buyer, the Buyer has the right to have the Seller deliver, free of charge and without undue delay, an item in conformity with the purchase contract, either by replacing the item or by repairing it. If this is not possible or is disproportionate, the Buyer has the right to a reasonable discount on the purchase price or may withdraw from the contract. Details are set out in Article 9 of these T&C.

6.2.3. The Buyer is obliged to pay the Seller properly and on time for goods or services delivered properly and on time.

6.3. The Buyer is advised to check the consignment upon receipt and to report any damage to the packaging or the consignment to the carrier and the Seller without undue delay.

7. Shipping – Delivery Methods and Their Price

7.1. The Seller’s shipping costs are not included in the purchase price of the product stated on the website. Delivery methods and delivery charges are set out in point 7.2 of this Article.

7.2. Delivery methods and the price of delivery of ordered products:

7.2.1. Delivery methods: Zásilkovna, PPL Box, PPL Home delivery (delivery to an address).

7.2.2. Delivery charges:

7.2.2.3. delivery via PPL Home delivery to an address: CZK 85 (incl. VAT).

7.2.3. For purchases over CZK 2,500, delivery is free. If, after part of the goods has been returned, the value of the order no longer reaches CZK 2,500, the Seller is entitled to reduce the amount to be refunded by the delivery charge the Buyer would have paid for an order of that value.

8. Consumer’s Withdrawal from the Purchase Contract Without Giving a Reason

8.1. In accordance with Section 1829(1) of the Civil Code, a consumer has the right to withdraw from a distance contract without giving a reason within 14 days from:

8.1.1. receipt of the goods under point 8.1.4 of this Article, in the case of contracts for the sale of goods,

8.1.2. conclusion of the contract, in the case of a contract for the provision of a service, or

8.1.3. conclusion of the contract, in the case of a contract for the supply of digital content not delivered on a tangible medium.

8.1.4. Goods are deemed received by the consumer at the moment when the consumer or a third party designated by the consumer (other than the carrier) takes over all parts of the ordered goods, or, where:

8.1.4.1. goods ordered by the consumer in one order are delivered separately – on receipt of the goods delivered last,

8.1.4.2. goods consisting of several parts or pieces are delivered – on receipt of the last part or last piece,

8.1.4.3. goods are delivered repeatedly during a specified period – on receipt of the first delivered goods.

8.1.5. If the Seller fails to fulfil its duty to inform the consumer of the right of withdrawal, the withdrawal period is extended. If the Seller provides the information later, the period expires 14 days after the day on which the information was provided; if the Seller does not provide it even later, the period expires at the latest one year and 14 days after the day on which it would otherwise have started to run.

8.1.6. The consumer may withdraw from a contract for the delivery of goods even before the withdrawal period begins to run.

8.2. The consumer is obliged to send the goods back, or hand them over to the Seller or a person authorised by the Seller to receive the goods, no later than 14 days from the day of withdrawal from the contract. This does not apply if the Seller proposes to collect the goods in person or through a person authorised by the Seller. The period is deemed observed if the goods were dispatched no later than the last day of the period.

8.3. A consumer who wishes to exercise this right must notify the Seller of the withdrawal within the statutory period. The period is observed if the notice was sent to the Seller no later than the last day of the period to the Seller’s registered office: Curliculum s. r. o., Budovcova 188/1, 130 00 Prague, Czech Republic, or to the e-mail address info@curliculum.com.

8.4. The consumer must express the withdrawal by an unambiguous statement. For evidentiary reasons, it is recommended to make the withdrawal in writing or in a record on another durable medium (in particular by e-mail). Withdrawal may also be made using the withdrawal form available on the Seller’s website. The consumer is advised to state in the withdrawal the order number, date of purchase, type of goods from which they are withdrawing, their first name and surname, address and, where applicable, the bank account number to which the payments are to be refunded. Otherwise the Seller will refund the payment in the same manner the consumer used to pay.

8.5. To withdraw from the contract without giving a reason, the consumer may use the form available at: https://www.curliculum.com/cs/pages/formular-pro-odstoupeni-od-smlouvy. The form is freely available for viewing and download on the Seller’s website.

8.6. Withdrawal cancels the contract from the beginning, and the parties are obliged to return to each other what they have received under the contract. The consumer is liable only for a reduction in the value of the goods resulting from handling the goods beyond what is necessary to become acquainted with their nature, properties and functionality. The consumer is not liable for a reduction in the value of the goods if the Seller did not provide the information on the right to withdraw from the contract.

8.7. On withdrawal from the contract, the consumer bears only the costs of returning the goods to the Seller or to a person authorised by the Seller to receive the goods, even if the goods cannot, by their nature, be returned by ordinary postal service. This does not apply if the Seller agreed to bear these costs itself or if it did not provide the consumer with information on the right to withdraw from the contract.

8.8. The Seller is obliged to refund to the consumer, without undue delay and at the latest within 14 days of the day of withdrawal from the contract, all payments received from the consumer under or in connection with the contract, including the costs of transport and delivery of the goods.

8.9. The Seller is not obliged to reimburse the consumer for additional costs if the consumer expressly chose a delivery method other than the cheapest standard delivery method offered by the Seller. Additional costs are the difference between the delivery costs chosen by the consumer and the costs of the cheapest standard delivery method offered by the Seller.

8.10. The Seller is entitled to refund the money to the consumer only after the goods have been returned to it or after the consumer has proved that the goods were sent back, unless the Seller proposes to collect the goods in person or through a person authorised by the Seller.

8.11. The Seller refunds the money in the same manner in which it received it from the consumer. A different method of refund is possible only with the consumer’s consent, provided that no additional costs arise for the consumer.

8.12. Consignments sent to the Seller on withdrawal from the contract as cash on delivery will not be accepted by the Seller. Consumers are advised to send goods by registered mail or a similar method without stating a cash-on-delivery amount.

8.13. Apart from the obligations set out in this Article, the exercise of the consumer’s right of withdrawal must not give rise to any further costs or other obligations for the consumer.

8.14. In accordance with Section 1837 of the Civil Code, a contract cannot, among other things, be withdrawn from where it concerns:

a) the provision of services, if they were performed with the consumer’s prior express consent before the expiry of the withdrawal period and the Seller informed the consumer before the conclusion of the contract that in such a case the consumer has no right of withdrawal,

b) the supply of goods or services whose price depends on fluctuations in the financial market independent of the Seller’s will and which may occur during the withdrawal period,

c) the supply of goods modified according to the consumer’s wishes or for the consumer’s person,

d) the supply of goods liable to speedy deterioration, as well as goods that were irretrievably mixed with other goods after delivery,

e) the supply of goods in sealed packaging that the consumer has removed from the packaging and that cannot be returned for reasons of health protection or hygiene (in particular cosmetic and hygiene products once the original packaging has been broken),

f) the supply of an audio or video recording or computer program if its original packaging has been broken,

g) the supply of newspapers, periodicals or magazines, with the exception of subscriptions,

h) accommodation for purposes other than residential, transport, car rental, catering or leisure services, if the Seller provides them on a specified date,

i) the supply of digital content not delivered on a tangible medium, if it was supplied with the consumer’s prior express consent before the expiry of the withdrawal period and the Seller informed the consumer before the conclusion of the contract that in such a case the consumer has no right of withdrawal,

j) other cases laid down in Section 1837 of the Civil Code.

9. Liability for Defects and Complaints

9.1. The Buyer’s rights arising from defective performance are governed by the relevant generally binding legal regulations, in particular Sections 1914 to 1925, 2099 to 2117 and 2161 to 2174 of the Civil Code and, for consumers, also by the Consumer Protection Act.

9.2. The Seller is liable to the Buyer for the goods being free of defects upon receipt. In particular, the Seller is liable for the goods having the properties agreed between the parties and, if none were agreed, the properties described by the Seller or expected given the nature and purpose of the goods, being fit for their usual purpose, being of the appropriate quantity, quality and workmanship, and complying with legal requirements.

9.3. A consumer may exercise rights arising from defective performance for a defect that appears in the goods within 24 months of receipt (Section 2165(1) of the Civil Code). A defect that appears within one year of receipt of the goods is presumed to have existed at the time of receipt (Section 2161(5) of the Civil Code).

9.4. If the goods are defective, the consumer has the right to have them brought free of charge into conformity with the contract, at the consumer’s choice by repair or by delivery of new goods, unless the chosen method is impossible or disproportionate given the nature of the defect. If the defect cannot be remedied in this way, the defect recurs after repair, the defect is material, or the Seller does not remedy the defect within a reasonable time, the consumer has the right to a reasonable discount on the purchase price or may withdraw from the contract.

9.5. Rights arising from defective performance cannot be exercised for defects caused by the Buyer, for defects the Buyer knew about before receipt, or for normal wear and tear caused by ordinary use of the goods. The Buyer also has no right arising from defective performance if the defect arose from improper handling of the goods contrary to the instructions for use.

9.6. The Buyer exercises rights arising from defective performance (a complaint) with the Seller at its registered office or at the e-mail address info@curliculum.com; the current procedure and complaint address are set out at https://www.curliculum.com/pages/reklamace-zbozi. The Seller will issue the Buyer a written confirmation of when the Buyer exercised the right, what the complaint concerns and what method of resolution the Buyer requests.

9.7. The Seller will decide on the complaint without undue delay, at the latest within 30 days of the day it was made, unless the Seller agrees a longer period with the Buyer. After the complaint has been resolved, the Seller will inform the Buyer of the outcome in writing and invite the Buyer to take over the goods.

10. Out-of-Court Resolution of Consumer Disputes

10.1. If the consumer is not satisfied with the way the Seller has handled the complaint, or believes that the Seller has infringed the consumer’s rights, the consumer has the right to ask the Seller for a remedy (Section 20d of the Consumer Protection Act). If the Seller rejects the request or does not respond within 30 days of the day it was sent, the consumer has the right to file a proposal to initiate out-of-court dispute resolution.

10.2. The body competent for out-of-court resolution of consumer disputes arising from the purchase contract is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, Company ID: 000 20 869, website: https://adr.coi.cz/cs, or another body for out-of-court resolution of consumer disputes that is competent to resolve the given dispute under the Consumer Protection Act.

10.3. In cross-border disputes, the consumer may also contact the European Consumer Centre Czech Republic (Evropské spotřebitelské centrum Česká republika), Štěpánská 567/15, 120 00 Prague 2, website: https://evropskyspotrebitel.cz.

11. Final Provisions

11.1. The Seller reserves the right to amend these T&C. The duty to notify of an amendment is fulfilled by publishing the amended T&C in the Seller’s online store. In the event of an amendment of the T&C, the relationship between the Buyer and the Seller is governed by the T&C valid and effective at the time the purchase contract was concluded, until its termination.

11.2. Contractual relations with consumers are governed, besides these T&C and the general provisions of the Civil Code, also by special legal regulations, in particular the Consumer Protection Act.

11.3. The legal relations between the Seller and the Buyer are governed by the law of the Czech Republic. Where the Buyer is a consumer, the choice of law does not deprive the Buyer of the protection afforded by provisions of the law of the state of the Buyer’s habitual residence that cannot be derogated from by agreement (Article 6(2) of Regulation (EC) No 593/2008 of the European Parliament and of the Council, Rome I).

11.4. These T&C form an integral part of the complaints procedure and of the personal data protection policy of this online store. Information on the processing of personal data under Regulation (EU) 2016/679 (GDPR) is published at https://www.curliculum.com/pages/ochrana-osobnich-udaju.

11.5. These T&C become valid and effective upon their publication in the Seller’s online store on 1.7.2026.
